The Good News and the Bad

The good news is that Greater Manchester Mayor Andy Burnham is proposing to drop plans for a Clean Air Zone (CAZ) scheme that would charge motorists similar to the Birmingham and London schemes. But it depends on agreement with the Government. The charging scheme had already been “paused” until 2026 but now looks like it will be scrapped. The bad news is that the Daily Telegraph have reported that the Government is to finance Mini-Holland cycling schemes to encourage people to ditch their cars in Britain’s major cities under government plans.

Nineteen local authorities, including Manchester, Hull and Nottinghamshire, are to get government funds for mini-Hollands with segregated bike lanes, traffic calming and residential streets blocked to cars.

It is suggested officials have steered away from describing any of the projects as Low Traffic Neighbourhoods (LTNs), which have provoked intense local opposition over road closures and claims of increased congestion on boundary highways in some areas. Comment: I cannot understand why people think that Holland is a good example to follow. There may be more cycling in some Dutch cities such as Amsterdam but nationally there are more casualties to cyclists than in the UK and traffic congestion is also worse. There is no evidence that introducing such schemes increases cycling (or “active travel”) in the UK. Cycling remains a fair-weather transport mode only followed by young males in flat locations. If people calling for mini-Hollands actually bothered to visit Holland they would see a very different picture. The only good aspect is that Holland has encouraged more off-road cycle paths that separate vehicle traffic from cyclists.  

Instead of spending £200 million on encouraging cycling the Government should spend it on improving the road network to improve road safety and cut traffic congestion.

Another good article in the Telegraph was entitled “Why Boris and the elite are determined to wean us off the car”. It said “Exasperated motorists are feeling pushed out of the picture with rising fuel costs, congestion charges, low traffic zones and speeding fines, and motorists, especially those who travel into cities, feel they are being hit from every direction. Dead ahead there are closed off roads in low traffic neighbourhoods (LTNs); to the left there are automated cameras monitoring their every move; to the right low emission zones and 20mph limits. And all around are parking charges and fuel costs that put a hefty dent in your wallet”; “There has now developed in Government an anti-car attitude as opposed to car management, a hostility to the motor vehicle rather than how we can manage this, says former transport minister John Spellar. He puts this down to a London-centric approach to transport that focuses on the problems cars cause in congested cities and ignores different conditions in other areas. As Spellar points out, working Britons outside the capital – particularly manual and shift workers – often rely on their vehicles to get to work, unlike city commuters who can travel by train”. Good News for Londoners, and The Truth About TfL Budgets

As readers probably know, the Mayor of London, Sadiq Khan, has run out of money with the result that Transport for London has had to be bailed out by the Government. The Mayor subsequently decided to raise the Congestion Tax by 30% and restrict usage of the Freedom Pass. That’s bad news but one consequence is that the funds provided by TfL to London boroughs for such projects as “Healthy Neighbourhoods” or “Mini-Hollands” will be curtailed.

An article in Local Transport Today (LTT) reports that in a letter to Transport Commissioner, Mike Brown, borough representatives have complained about what this will mean in terms of their operations and their ability to deliver transport projects.

Local boroughs are under great financial pressure from the Covid-19 epidemic because it has resulted in a loss of much of their parking income and PCNs. Now they may lose one of the major sources of funds for transport projects. To quote from the LTT article: “Frost and Jones say there is a risk that boroughs may “no longer be able to assist TfL in delivering the Mayor’s Transport Strategy (MTS) in any meaningful way.  This would be particularly damaging because, as the MTS acknowledges, the boroughs are a key delivery partner as the authorities, which manage the vast majority of London’s highway network. They say a “severe reduction” in borough capacity will also “hamper the opportunity for officers to work with TfL to explore how some of the positive behaviour changes observed on the network in recent weeks (improved air quality, more active travel, reduced private vehicle trips etc) can be locked-in and a ‘new normal’ forged.  This could therefore represent an historic missed opportunity in what is likely to be a very small window of time where people may be open to doing things radically differently”.

We suggest that scrapping projects that involve road closures, reducing road capacity and the expenditure on more cycle lanes which are little used would be a very good idea indeed. We have been campaigning against the MTS since it was launched as it is a misconceived attempt to change travel behaviour, force people to travel as the Mayor and TfL want rather than by their choice, and has never been justified by any cost/benefit analysis.

One example of the new financial limitations was indicated in a note issued by a Lewisham councillor. It said: “Healthy Neighbourhoods – while the lockdown has highlighted how pleasant life can be without traffic, TfL’s parlous finances mean it has halted funding for HNP. The Council is looking at whether and how the plans for Lee Green and central Lewisham can be integrated into some temporary measures we have funding for as part of Covid-19 response that would encourage social distancing, walking and cycling. We expect to be able publish these within the next few weeks”.

It seems neither the Council nor central Government is giving up on wanting us all to walk and cycle everywhere to relieve the pressure on public transport and avoid the close contact and hence infection risk on buses and the underground. But the Mayor’s policy of raising the Congestion Tax and taxes such as the ULEZ will pressure people to stop using cars and move to public transport. It’s simply irrational.

A good letter was published in the Times newspaper on this subject from John Hines who lives in Loughton, Essex. This is part of what it said: “This is bound to push more travellers back on to trains, the Tube and buses, where social distancing is next to impossible. One would hope he has calculated the effect this will have on the R number. He should be held to account, particularly as many of us who travel into London do not live in London and have no say in who is elected mayor”.

The Government has made it plain that it was solely the Mayor’s decision to raise the Congestion Tax and that he should not blame them. They also said this in a note issued on the bail-out: “The settlement for TfL was needed for two reasons. Most important is the significant fall in revenue caused by COVID-19. However, an important secondary factor was the pre-existing poor condition of TfL’s financial position as a result of decisions made over the last 4 years. Combined with significant cost increases and delays to Crossrail, this left TfL in serious financial difficulty even before the public health emergency.

The Mayor has claimed a great success in achieving a reduced operating loss in TfL. But this ignores all the wasted capital expenditure on projects such as Cycle Superhighways and the interest on debt that has risen to record levels. Is it not time for the Government to step in and take full control of TfL? It is wrong for the Mayor to pursue reckless policies such as his Transport Strategy when there is no financial justification and no democratic mandate for it.

But the Government is actually recklessly encouraging local Councils to “embed new social norms” for travel by restricting vehicle use and encouraging walking and cycling. They want to change the way you wish to travel and to live without consultation and with no justification. That’s not democracy.

Mini-Hollands and Why Road Closures May Be Illegal

HollandBoris Johnson has announced a £5 billion fund to “overhaul bus and cycle links for every region outside London”. This, he said, would result in cyclists “enjoying hundreds of miles of brand-new separated lanes, with ‘mini-Hollands’ blooming like so many tulips in towns and cities right across the country”. Mini-Hollands were first promoted by Mr Johnson when he was Mayor of London and are being implemented in several London Boroughs. Exactly what are Mini-Hollands?

In reality there is no clear definition but they typically involve the promotion of cycling with more cycle lanes, junction improvements to improve safety and road closures to reduce traffic. This web page gives details of the schemes in the London Boroughs of Enfield, Kingston and Waltham Forest but there are several other boroughs planning similar schemes: https://tinyurl.com/wemwlba . Sometimes they are called something different so in Lewisham their plans are named “Healthy Neighbourhoods”.  But they have one thing in common – they are all prejudicial to the interests of car users. They are even damaging to the interests of bus users as additional traffic congestion delays buses and causes some routes to be cut as bus lanes are “repurposed” as cycle lanes.

Most of these schemes include road closures that aim to reduce traffic by simply blocking it. In reality people don’t stop using cars they simply find alternative longer routes that typically add to congestion on main roads and increase air pollution.

There are also major concerns about delays to emergency service vehicles (ambulances, fire engines and police) as delays to those can cost lives. This problem is being ignored by proponents of such schemes. They also ignore the fact that the disabled and elderly can use cars when they cannot walk far or cycle, and that some journeys are simply impractical via public transport.

The schemes are often put in without proper public consultation and there is enormous opposition to road closures. But are such closures actually legal?

Legal Considerations

Can a local Council legally close roads? Roads can be closed by the use of Traffic Orders but there needs to be reasonable justification for such closures and time given for objections. There are also several Acts of Parliament that might be relevant. For example:

–         The Road Traffic Act 1984 which contains this sentence (in Section 122): “It shall be the duty of the Greater London Council and of every other local authority upon whom functions are conferred by or under this Act, so to exercise the functions conferred on them by this Act …. to secure the expeditious, convenient and safe movement of vehicular and other traffic….”. Road closures aimed simply at reducing traffic appear to be ignoring that duty.

–         The Traffic Management Act 2004 which puts a duty on local traffic authorities to manage their road network to make sure that traffic can move freely. Again this duty is being ignored.

–         The Equalities Act 2010 which restricts discrimination against people with disabilities or based on age when road closure proposals negatively impact those sections of the community.

These pieces of legislation might enable a challenge to any such proposals.

Make Sure You Oppose Them

Readers should make sure they oppose such schemes. Mini-Hollands are not a way to improve the health of the population and as cycling is an inherently more dangerous way of travelling, encouraging it actually makes road casualty statistics worse (as is apparent in the figures from Holland).

Mini-Hollands are a euphemistic name for damaging road closures which create enormous inconvenience for road users. It’s all double Dutch to anyone who knows much about road safety, traffic and environmental issues.
